I also will not sell, rent, reveal, display, loan, give, show, or cause to be seen the same by any minor under the age of eighteen (18) (under 21 in AL, MS, NE and WY) or to anyone that may be offended by such material and that I am solely responsible for any and all materials that I obtain or access from FreakDawg Productions.

In addition, I agree that I will not rent, give, loan, display, or post my user ID or password which allows me access to FreakDawg Productions to any adult or minor under eighteen (18) years of age (under 21 in AL, MS, NE and WY).

I agree that any charges incurred from the use or misuse of my user ID or password from third parties shall by my sole responsibility.

I agree that FreakDawg Productions will not be responsible for any liabilities, damages, (direct, indirect, consequential or otherwise) costs, and /or expenses which FreakDawg Productions may occur by reason of any action and/or inaction, either deliberate or in-deliberate, that might cause a breach of this agreement.

I furthermore acknowledge that FreakDawg Productions is a combination original/compilation copyrighted Internet web site, and I agree that I will not post any of the material found on FreakDawg Productions on or to any other medium or for ANY type of distribution. I understand and agree to abide by all Federal & International Copyright Protections afforded to the coypright holders and protected owners of materials on FreakDawg Productions under US & International law. I also understand and agree that the "Fair Use Act" under US Copyright law does not apply to the distribution of or posting of ANY copyrighted and/or protected materials to mass groups of users or other parties including but not limited to newgroups, internet clubs, bulletin boards, maillists, or other similar forums without the express permission of the owners and/or copyright holders of said material and that this understanding applies specifically to any material accessed through FreakDawg Productions.

I understand and fully agree that I am solely responsible for the use of my computer and all accounts accessed through my computer and/or any other web-enabled device, including usage by all third parties of my computer or web-enabled device. I fully understand that FreakDawg Productions electronically/digitally "watermarks" it's copyrighted images and other protected material and may randomly trace any of its materials or images downloaded from the FreakDawg Production website at any time. I understand and agree that I will assume all costs incurred, civil legal liability, and financial liability incurred by any action brought against me by FreakDawg Productions should I be found in violation of FreakDawg Productions copyrights and/or protected status and/or any part of this agreement; pursuant to said finding, I forfeit my privacy rights and give permission to my Internet Service Provider(s) (ISP) to release any and all personal and/or other information that I have given them to FreakDawg Productions should FreakDawg Productions request said information in its pursuit of legal or financial recourse to address copyright violations or other violations of protected status.

I agree that any returned checking debits submitted to FreakDawg Productions/John Bernard Jones by Subscriber will be subject to a fee where limited only by current state law in the state of New York.

I agree that FreakDawg Productions has the right to cancel their service at any time due to reasons such as, but not limited to, governmental regulation, natural disasters, or other unforeseen circumstances. I expressly agree that the use or access to FreakDawg Productions is solely at my own risk. I understand that neither FreakDawg Productions, its' owners, employees, suppliers, contractors, resources, services, and/or facilities of FreakDawg Productions, make any warrant as to what may be obtained from access to FreakDawg Productions. The materials on FreakDawg Productions are distributed as is without any warranty of any kind, either express or implied, including but not limited to warranties or merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.

Neither FreakDawg Productions nor any person or entity involved in FreakDawg Productions shall be liable for any direct, indirect, incidental, or special damages arising out of the use or inability to use FreakDawg Productions or any breach of warranty.

As a subscriber I expressly agree that the provisions of this paragraph shall also apply to any third party contracts. I also agree that any material and or data I obtain from FreakDawg Productions via electronic transfer I do so at my own discretion and risk. I will indemnify and hold harmless FreakDawg Productions, its owners, employees, agents, contractors and/or representatives for any damaged caused to my computer system from my direct or indirect transferring of materials and/or data by my accessing FreakDawg Productions.

I agree that as I subscribe via credit card or electronic checking debit, that I understand that if my membership option is "monthly recurring", that each month (or each period, depending on which subscription option I choose) my supplied credit card or checking account will be charged the membership fee. If I would like to cancel my membership, which I may do at any time after the first full month, I will cancel using the cancellation instructions as provided on the website and/or via the billing agent. We agree to cancel your account upon your written notice.

I agree that if any provisions of this agreement are held by any court to be invalid, void, or unenforceable, the remaining provisions continue in full effect.

This agreement shall be construed under the laws of the state of Georgia and the Georgia court system shall have sole legal jurisdiction over any controversy relating to any and all portions and/or provisions of this agreement.

PRIVACY: I understand that by joining this website, my privacy rights are assured and that my personal information will not be shared or sold to any commercial entity, private concern, or otherwise violated without my permission, with the exception of any legally requested information in cooperation with local, state, or Federal authorities.

FreakDawg Productions is a media & website property owned by John Bernard Jones. I understand and agree that under any name change and/or change of ownership of FreakDawg Productions, the provisions of this contract will remain in effect and valid unless and/or until subsequent notice thereto.
